SINGLE MEMBER ADMISSION

Application. There shall be an application for admission to join 1up Clan. No person shall be deemed to have applied for 1up Clan membership without satisfying the requirement of filling out the official 1up Clan Application.[1] This rule shall govern self applicants and invite applicants. (The official application is located at: http://www.1upclan.info/apply.php).

Clan Review Vote. In no event shall an applicant be approved for 1up Clan membership without obtaining a 70% majority approval.
A). Procedure. A vote on a pending 1up Clan Application for admission of an "Invite Applicant" may not be called until five (5) calendar days have passed from the date of filing the application for admission. A vote on a pending 1up Clan Application for admission of a "Self Applicant" may not be called until ten (10) calendar days have passed from the date of filing the application for admission. 
B). 70% Requirement. In order for an applicant to pass the Clan Review Vote, a 70% majority must approve. There shall be three types of votes that may be cast in a Clan Review Vote proceeding over a completed 1up Clan Application:
  • "Yes",
  • "No",
  • "Trial".

Voluntary Vote. All 1ups eligible to vote may voluntarily cast a vote during the period a voting poll is open.

Time Limitations. If a vote is called up on a pending 1up Clan Application, each potential voter must cast their vote within five (5) days.

Exception. A non-voting Clan Member and Clan Trial Member shall be excluded from the 70% Requirement. Any person ineligible to cast a vote shall not be included in the 70% Requirement.

Rejection. (1) In any case where an applicant for admission is found to be a Hacker, such application will be automatically rejected in whole without the need for a majority vote. (2) In any case where an applicant is found to have been untruthful or significantly deceptive in the 1up application process, such application will be dismissed with prejudice. (3) In the event that an applicant for admission incurs a justified 1up server ban or a justified ban from the 1up forum, such application shall be dismissed with prejudice.[2]

Limitations: (Denials/Terminations). The following limitations govern member admission in cases of denials or terminations.[3]
  • 1st Denial. A person who has been denied admission shall be ineligible to file a successive Application for Admission to 1up Clan unless 30 days have passed from the date of denial.
  • 2nd Denial. A person who has twice been denied admission to 1up Clan shall be ineligible to reapply as a self applicant, however, such person upon receipt of an official invite from the clan to apply, if such invite is offered,[4] shall be permitted to proceed as an invite-applicant.
  • 1st Termination. A person who resigns from the clan, is ejected, removed, or kicked out, shall wait 120 days before filing a second or successive application for admission to 1up Clan.
  • 2nd Termination. In no event shall a person who terminates a second 1up membership (whether by resignation, ejection, removal, or other means) be permitted to reapply as a self-applicant, however, such person upon receipt of an official invite from the clan to apply, if such invite is offered, shall be permitted to proceed as an invite-applicant.
Limitations: (Applications/Dismissal). The following limitations govern member admission in cases of dismissals.[5]
  • 1st Dismissal. If an application for admission to 1up is dismissed due to a deficiency, then the dismissed applicant must wait a minimum of 30 days before refiling a second or successive application for admission to 1up.
  • 2nd Dismissal. If a second or successive application for admission to 1up is dismissed due to a deficiency, then the dismissed applicant must wait a minimum of 120 days before refiling a second or successive application for admission to 1up.
  • 3rd Dismissal. If a third application for admission to 1up is dismissed due to a deficiency, then the dismissed applicant must wait a minimum of 1 calendar year from the date of dismissal before refiling a successive application for admission to 1up.[6]
  • Age Based Dismissal. If an application for admission to 1up is dismissed due to applicant being underage or there is a substantial showing of evidence that the applicant is underage and lacks parental consent, then the dismissed applicant must wait a minimum of 1 calendar year from the date of dismissal before refiling a successive application for admission to 1up.
Abuse of Process. A party who violates the filing restrictions or the times-to-act in the application process shall be banned from posting on 1up Forum until expiration of the full-term duration of the most applicable cooling-off period to a denial/termination case or a dismissal case.

Inactivity During Application Term. A "pending" applicant who remains inactive for a period of ten days without just cause[7] may be dismissed by the Founder (or his agent), or a member of the Application Staff. Absent a showing of "just cause", if ten days of inactivity is noted on the scheduled vote date, then the application shall be dismissed with prejudiced.

Definitions:

The term "Invite Applicant" means a person who has been invited to apply.[8]

The term "Self Applicant" means a person who applies without an official invite to apply.

The term "Clan Trial Member" means a 1up applicant who has been awarded the 1up tag and accepted into the 1up Clan on a probationary period. The probationary period runs a minimum of 30 days up to a maximum of 90 days. The term shall not apply to any person who has not been awarded the 1up clan tag.

The term "Hacker" means a person who used or uses cheats or exploits (i.e., aimbot, wallhack, radar, mombot, etcetera).

Commentary:

Relationship. Once an application for admission to 1up Clan has been filed, each member should attempt to establish a relationship with the applicant. The value of a good relationship between clan members is an important factor to consider in deciding what vote to cast in the Clan Review Vote.

70% Requirement: The applicant needs a 70% majority vote to gain acceptance:

     A). 70% Yes. In the event that the applicant receives at least 70% of "yes" votes, the applicant will be approved as a Clan Member.

     B). 70% Trial. In the event that the applicant receives at least 70% of "trial" votes, the applicant will be approved as a Clan Trial Member.

     C). 70% Combo. In the event that the applicant receives at least 70% between a combination of "yes" and "trial" votes, the applicant will be approved as a Clan Trial Member.

Voluntary Vote. Effective October 28, 2010, voting is a voluntary act; mandatory voting requirements are repealed.

Amendment of May 15, 2010 altered the wait time before voting on a self applicant from a ten (10) day waiting period to a thirty (30) day waiting period.

Amendment of July 6, 2010 clarified the maximum limbo time for insufficiently presented applications for admission: "If an application is deficient it shall be dismissed within 3 days by either the Founder or the 1up Application Manager."

Amendment of October 28, 2010  repealed mandatory voting and created a voluntary voting state for full 1up Members who had 90 days or more in the seat of a 1up Full Member. Any 1up Full Member who held voting rights on the date of the new voting amendment was grandfathered into the voluntary voting group.

Amendment of March 23, 2011 limited the number of times a person may reapply to 1up after being denied admission; limited the number of times a person who has resigned or been removed from 1up may reapply for admission. Policy shall permit the use of invite applications to prevent abuse of the application process.

Amendment of June 9, 2012 changed the wait time on a "self-applicant" from 30 days to 10 days before permitting an admission vote to be called.

Amendment of April 12, 2013 changed the title from "New Member Admission" to "Single Member Admission" to prevent confusion between the "Clan Merger Admission" policy enacted on April 12, 2013.

Repealed Amendments.

The following amendment is repealed:

Amendment of September 1, 2010, a legal construction of the 30-day wait period for reapplying to 1up. The amendment provides an express and clarifying interpretation of the 30-day wait period: "If an application for admission to 1up is dismissed due to a deficiency, then the dismissed applicant must wait a minimum of 30 days before refiling a second or successive application for admission to 1up." Prior to the express and clarifying interpretation, 1up maintained the 30-day wait period as a matter of custom. The September 1, 2010 clarifying amendment construed the meaning of the term "denied admission" as used in the "Limitations" section to incorporate a person who files a deficient application for admission which is dismissed.
 1. The application submission procedure requires the individual to personally fill out and submit the application (not through a third party). The applicant must use their own 1up Forum account to submit the application. If an application is deficient it shall be dismissed within 3 days by either the Founder or the 1up Application Staff. If an application for admission to 1up is dismissed due to a deficiency, then the dismissed applicant must wait a minimum of 30 days before refiling a second or successive application for admission to 1up. A person who files a second deficient application which is not cured and which results in a dismissal shall have to wait a minimum of 120 days to refile, if ever.
 2. 1up also reserves the right to refuse to continue in the application process with any applicant for any reason. An example of a potential reason to discontinue an application would be in the case where an applicant exhibits disrespect to 1up Members whether vocally or in writing.
 3. The prior policy, amended March 23, 2011, provided:
"No person who having been denied admission shall file a successive Application for Admission to 1up Clan unless 30 days have passed from the date of denial. Further, any person who is ejected from 1up Clan, removed, or kicked out must wait 30 days before filing any application for admission to 1up Clan."
 4. Any invite applicant shall be immediately eligible to proceed in the application process. The force and effect of an official invite from the clan trumps the times-to-act provisions and general cooling-off periods applicable to self-applicants.
 5. This provision effectively repealed the Amendment of September 1, 2010. Incremental and elevated steps in the dismissal process are provided.
 6. Each dismissed application thereafter shall be subject to a 1 calendar year cooling-off period.
 7. A determination of just cause may include hospitalization, death in the family, loss of power, or involuntary inability factors.
 8. An invitation to join 1up may be extended by the Founder.
