INTERNAL CONFLICT RESOLUTION

1. Establishment. There is henceforth established a policy to provide for internal clan conflict resolution.

2. Purpose and Background. The purpose of this policy is to provide for internal conflict resolution. Disputes among clan members, if left unresolved, can create substantial conflict that leads to future internal clan problems. A two-tiered system of review shall provide for effective conflict resolution. 

3. Resolution Procedure:

     Phase 1: Informal Resolution: Contact the HR Manager

     The first step a clan member should take in seeking assistance to resolve an internal clan related problem is to contact the HR Manager. During this phase the HR Manager will interact with all parties and act as a mediator to provide a reasonable solution. Upon receipt of a request for assistance the HR Manager will privately document the event and the informal resolution provided. In some cases the HR Manager will not be able to reach an informal resolution because the parties will not amicably agree, which results in the HR Manager forwarding the matter to the Decision Panel.

     Phase 2: Formal Resolution: Contact the Decision Panel

     The second step a clan member should take in seeking assistance is to contact a member of the Decision Panel and provide a description of the problem, including information related to the informal resolution attempts. The Decision Panel will document the matter, interview relevant parties, consider comments from interested persons when appropriate, and convene to render a decision.

4. Decision and Finality. The written ruling of the Decision Panel is final and not subject to appeal. The parties involved must accept the ruling as binding.

5. Mitigation. In cases of involving clan member discipline any member of the Decision Panel may move the Chairman for mitigation of punishment. The decision to mitigate punishment is an exercise of discretion, which is not subject to rehearing, reconsideration or appeal. Circumstances that justify moving for mitigation of punishment includes, but is not limited to: new evidence or new testimony that was previously unavailable during the pendency of conflict review.

Terms and Definitions

"1up Decision Panel" (DP) is a division of the Clan clothed with authority to officially resolve conflict between clan members. This may include the adjudication of matters that involve violations of the 1up Code of Conduct. The DP is comprised of a Committee Chairman, Four Committee Members and two Alternate Members.

"1up Human Resources" (HR) is a division of the Clan that clothes a single member with authority to provide informal clan member conflict resolution. HR Management often acts as a mediator between parties in efforts to resolve conflict issues. Internal and external issues are often forwarded to HR for discussion, analysis, recommended action course or adjudication. The HR Manager sits on the DP as a Committee Member. IF the HR Manager is unable to reach an informal resolution between clan members, then the HR Manager presents the issue to the DP for official adjudication.
